Terms of Use

1. Acceptance of these terms

These Terms of Use ("Terms") govern your download and use of the RaceIt desktop application and online service ("RaceIt", "the app"), operated by Nils Rothenbühler, Pfäffikon ZH, Switzerland ("we", "us"). By installing, accessing, or using RaceIt, you agree to these Terms. If you do not agree, do not install or use the app.

2. What RaceIt is (and is not)

RaceIt is an independent, unofficial, non-commercial fan-made companion app that provides skill-based matchmaking and an ELO ranking for races in Forza Horizon 6. RaceIt is not affiliated with, endorsed by, sponsored by, or associated with Microsoft Corporation, Xbox Game Studios, Playground Games, or the Forza / Forza Horizon franchises. RaceIt does not modify, inject into, or alter the game; it reads the game's official "Data Out" telemetry locally to time races. All trademarks belong to their respective owners.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use RaceIt for your own private, non-commercial use. You may not sell, rent, sublicense, reverse engineer (except where permitted by mandatory law), or redistribute the app, or remove any notices contained in it.

4. Accounts & eligibility

RaceIt requires sign-in with a valid Steam account and a legitimate copy of the game. You are responsible for activity that occurs under your account and for keeping your credentials secure. You must be old enough to enter into a binding agreement in your country of residence, and you must comply with Valve/Steam's and the game's own terms of service.

5. Acceptable use & fair play

You agree not to:

• cheat, exploit bugs, manipulate results, or use automation to gain an unfair advantage;
• tamper with matchmaking, ranking, telemetry, or other players' sessions;
• harass, threaten, or abuse other players, including in match chat;
• post unlawful, infringing, or otherwise objectionable content;
• attempt to disrupt, overload, or gain unauthorised access to the service or its infrastructure.

You are solely responsible for any content you submit (such as chat messages). We may remove content and moderate the service to protect players and integrity.

6. Suspension & termination

We may suspend, restrict, ban, or terminate your access — temporarily or permanently, with or without notice — if you breach these Terms, cheat, or harm the service or other users. You may stop using RaceIt at any time and request deletion of your account (see our Privacy Policy).

7. Availability & changes

RaceIt is provided free of charge. We may change, suspend, or discontinue all or part of the service, including ranking systems, matchmaking, or features, at any time. We may also update these Terms; the current version is always available on this page, and continued use after changes constitutes acceptance.

8. Third-party services

RaceIt relies on third-party services including Steam (Valve), the game itself, and our backend providers (Supabase, Cloudflare, Vercel). Your use of those services is subject to their respective terms and policies, and we are not responsible for them.

9. Disclaimer of warranties

To the maximum extent permitted by law, RaceIt is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of rankings, or uninterrupted or error-free operation. You use the app at your own risk.

10. Limitation of liability

To the maximum extent permitted by Swiss law, we shall not be liable for any indirect, incidental, or consequential damages, loss of data, or loss of progress arising from your use of, or inability to use, RaceIt. Mandatory statutory liability (including for unlawful intent or gross negligence) remains unaffected.

11. Governing law & jurisdiction

These Terms are governed by the substantive law of Switzerland. To the extent permitted by law, the place of jurisdiction is Pfäffikon ZH, Switzerland. Mandatory consumer protection provisions of your country of residence remain unaffected.
